The Crown Prosecution Service (CPS) is a government service which employs prosecution lawyers; these prosecutors will argue a case against suspects (defendants) in court, they aim to get the suspect charged. A prosecutor aims to prove that the person(s) is guilty of the crime that they are being accused of. The prosecutor writes report and presents evidence in the court room. The prosecutors will communicate with the police, as well as other professionals that are involved in the investigation, they also speak to the victims of the crime. Prosecutors do this for the information that they can gather about the case so that they are able to have a full understanding of the case, this allows them to prosecute the case to the best of their ability.The prosecution would then prepare a report combining all the evidence and statements of those involved in the case, this is used within the court case against the defendant, the report contains all of the information gathered as well as information regarding evidence. The prosecutor would then present the evidence in court in front of the judge and a jury (if present). This evidence is compiled of forensic evidence and any intelligence gathered throughout the investigation. The presentation of this evidence allows the court to decide if the defendant is guilty or innocent.
In the case of Christine Jessop Guy Paul Morins first trail (February 7th 1992) shouldn't have went ahead due to a lack of evidence however it did, they also forgot to mention the contamination of the semen samples to the jury. While in court the defence stated that Guy Paul wouldn't have been able to abduct her due to the timing however the detectives encouraged the Jessops to change their statement so that Guy Paul seemed guilty. He was sent to prison labeled as a child murderer, his defence pushed for another court appearance. Guy Paul eventually got his second court hearing (July 23rd 1992)where the prosecutors used a jailhouse snitch known as 'Mr. X' this snitch stated that Guy Paul boasted and bragged about killing Christine even though Guy Paul always said he was innocent but was sent back to prison. Guy Paul was finally released on January 23rd 1995 and awarded $1.5 Million, he was released after a third trial was called were all the evidence and they went of the DNA results only due to the advances in DNA technology and was found not guilty.
Prosecutors will be involved in investigations only if they are presented in court. In any case the prosecutor’s role will be similar. This is because in any case the prosecutor’s responsibility is to prove the defendant carried out the crime that they are being charged with. The only difference that will occur in the case is that the evidence and arguments presented by the prosecution will be different.
9 Year Old Christine Jessop went missing on the 3rd October 1984 and found the 31st of December. Guy Paul Morin was wrongly convicted October 1984, this blog will go through the case and all its details.
